Ryan Pigg represented a railroad worker who sustained neck and back injuries as a result of a train derailing in a train yard outside of a chemical plant. Due to neglected maintenance, the gauge of this particular track became out of gauge per FRA regulations. The widened gauge allowed the cars to separate from the track and lean significantly. The worker was forced to jump from the moving car and land on the track bed. Discovery revealed that Defendants failed to maintain the track for nearly two years, when FRA regulations require regular inspections at least every 28 days.
